August 2017 update - Amendment C164 approved by the Minister for Planning

In a letter dated 19 July 2017 to Council, the Minister for Planning issued notice of approval for Amendment C164. The amendment and associated Heritage Overlays came into affect when notice of its approval was published in the Victorian Government Gazette on 10 August 2017.

March 2017 update - Amendment C164 adopted

A report went to the Ordinary Meeting of Council on 28 February 2017. The purpose of the report was to advise Council of the recommendations of the Independent Panel appointed by the Minister for Planning to consider submissions with regard to Amendment C164. The report also recommended that Council adopt the amendment and the updated Heritage Study 2015.

Council adopted the amendment and it has been sent to the Minister for Planning for final approval.

December 2016 update

A Planning Panel was held from Monday, 10 October through to Thursday, 13 October 2016 to hear unresolved submissions to this amendment.

You can view the Panel Report for Amendment C164 (pdf, 1MB) which issued on 1 December 2016.

A report will be presented at the Ordinary Council Meeting in February next year to consider panel recommendations.

August 2016 update - Panel Hearing process

The Directions Hearing for Amendment C164 was held on Monday, 22 August 2016.

The purpose of the Directions Hearing was to make arrangements for the running of the Panel Hearing, which will be held from Monday, 10 October through to Friday, 14 October at The ClockTower Centre, 750 Mt Alexander Road, Moonee Ponds.

July 2016 update

At its Ordinary Council Meeting on Tuesday, 22 March 2016, Council adopted the Heritage Study 2016 (pdf, 11MB) and resolved to seek Ministerial authorisation to prepare and exhibit Amendment C164 to the Moonee Valley Planning Scheme.

Amendment C164 seeks to apply the Heritage Overlay on a permanent basis to places and precincts identified within our Heritage Study 2015.

The amendment was exhibited from 9 June to 14 July 2016. Council Officers are currently reviewing 20 submission received during the exhibition period.

How can I have my say?

The deadline for community feedback closed on Thursday, 14 July 2016. Any queries on the status of the amendment can be emailed to heritagestudy@mvcc.vic.gov.au.

What is the process from here?

We will now consider all submissions received. Should there be issues raised with the proposed amendment that are unable to be resolved, we will refer the submissions for review to a Planning Panel which is independent of Council.

This panel would then provide a recommendation back to Council. Council can then decide whether to adopt the amendment, adopt the amendment with changes or abandon the amendment.

If the amendment is adopted by Council, it would then be sent to the Minister for Planning for final approval.

Planning Scheme Amendment C1645 - Implementing interim heritage controls following the Heritage Study 2015

At its Ordinary Council Meeting on Tuesday, 22 March 2016, Council also resolved to write to the Minister for Planning requesting interim heritage controls for the places and precincts identified in the Heritage Study 2015 until such time as permanent Heritage Controls can be considered.

Amendment C165 seeks to apply the Heritage Overlay on an interim basis to places and precincts identified within Council’s Heritage Study 2015.

The Minister for Planning via his department wrote to Council on 25 June 2016, advising that the request for interim heritage controls had been refused.

The department has advised that it is standard practice to limit the application of interim Heritage Overlays to;

  • Instances where Council has received a request for demolition of a building of potential heritage significance; or
  • Instances where a planning permit application is received which involves the demolition or redevelopment of a building of potential heritage significance.

As the department’s parameters listed above are not met, the request for interim controls in this instance has been refused.
