Section 29A demolition consent

You may need to make a request under Section 29A of the Building Act 1993 and Building Regulations 2018 for report and consent to demolish.

A Section 29A can be submitted to Council electronically through our online applications portal.

When consent is required

Under Section 29A of the Building Act 1993 and the Building Regulations 2018, consent from Council is required before a building permit for demolition is issued if:

  • all demolitions finished or permitted within three years of the application add up to more than 50% of the entire building, or
  • the proposal includes demolishing any part of the facade of a building.

A Section 29A demolition consent is a separate approval process to a planning or building permit.

In some cases, a planning permit for demolition may also be required (such as if the building is within a Heritage Overlay). This approval must be obtained before you apply for a Section 29A demolition consent.

What is required

You will need to provide Council with a demolition plan and if applicable, the planning permit number relating to your proposed demolition.

A demolition plan must include a drawing, a site plan, or an aerial image of the property, to its boundaries, showing all existing structures.

Any areas designated for demolition should be highlighted and clearly labelled as ‘to be demolished’. If you have demolition plans already endorsed as part of a permit approved by this council, these should be submitted in lieu of this.

What happens after you lodge an application

Once you lodge your request for demolition consent, it will be allocated to a planner for assessment. The planner will determine if a planning permit is required for the proposed demolition. In instances where a planning permit is required for demolition, the planner will verify that a planning permit has been issued.

We will approve a Section 29A consent request if:

  • A planning permit has been issued for the demolition, or
  • A planning permit is not required for demolition.

We will refuse a Section 29A consent request if:

  • A planning permit for demolition is required and no such permit has been issued, or
  • the proposed demolition is different from the extent of demolition approved in the planning permit.

All approved demolition consents properties need to surrender all of the household bins including general rubbish, recycling and FOGO bins.
