Out of hours construction work permit

 

We understand that, in some situations, building works may need to take place outside of standard permitted hours.

However, because of the potential impact on nearby residents and the wider community, these requests must be supported by clear and reasonable justification.

All requests are carefully reviewed and require formal approval.

When assessing applications, we consider the potential impacts on residents and stakeholders, as well as the specific circumstances of each request.

 

Permitted Hours

The following permitted working hours are outlined in the General Purposes Local Law 2018;

  • 7am and 6pm Monday to Friday
  • 9am and 3pm on Saturday
  • No works on Sundays or public holidays  

 

You must have an Out of Hours Permit to conduct construction works outside of these permitted hours.

An Out of Hours Permit may be granted to construction sites with a Planning Permit where:

  • the Planning Permit requires a Construction and Site Management Plan;
  • the nature of the works is more practical to undertake on a weekend;
  • the works cannot reasonably be completed within standard working hours;
  • over-sized loads cannot be transported during normal permitted hours;
  • a service authority require works out normal hours;
  • undertaking the works out of hours will reduce disruption to public transport or avoid power outages; or
  • it will minimise impacts on surrounding businesses and residents

 

How to apply

A minimum of 10 days is required to process the application. In addition, a 7 day  notification period to residents and businesses must also be provided.

Complete and return an Out of Hours Permit application form (docx, 41KB) to outofhourspermits@mvcc.vic.gov.au.

 

The following MUST be attached:
  • A copy of the notification letter to residents. This must be approved by Council prior to being sent out. 
  • A map of the notification zone and houses to be notified.
  • A copy of the Traffic Management Plan (TMP).

 

The notification letter must include the following:
  • The date the letter is to be distributed;
  • A description of the work, full site address and location;
  • The purpose for the out of hours construction works;
  • A description of the works approved, including type of works, location of works and potential amenity impact including any road or foot path closures;
  • The date and time the work will be undertaken;
  • A locality plan of the site (to be provided on the reverse side of the letter); and
  • The name and phone number of a contact person on site and during the works.

 

If you are issued an Out of Hours Permit, you must comply with all permit conditions.

If an authorised officer determines that a condition has been breached, you will be required to cease works immediately. Your permit may be revoked, and enforcement action, including a planning infringement notice, may be issued.
